General Terms of Delivery and Payment
- The seller's catalog descriptions are to be understood as guidelines with regard to price information. The price specified in the specific offer is decisive for the purchase price.
- Delivery times are based on the specific offer. Late deliveries do not entitle the buyer to claim damages.
- The agreed price does not include transport costs. The goods must be collected by the buyer in Emmen. The transport risk and transport costs are borne by the buyer.
- Invoices are payable net within 30 days. If this deadline is not met, interest on arrears of 5% will be charged without reminder.
- The delivered goods remain the property of the seller until the entire purchase price, including any interest and costs, has been paid in full. The seller is authorized to have the retention of title entered in the retention of title register at the buyer's place of residence.
- Upon receipt, the buyer must inspect the goods within 5 working days. Any defects must be reported immediately after inspection. In the event of a warranty claim (material defect), the buyer may only demand that the defect be remedied or that the defective parts of the goods be replaced. Price reductions are excluded.
- Any liability or obligation to provide compensation on the part of the seller is limited to the delivered goods (material defects) themselves. Any further claims for damages or liability of any kind (in particular for indirect damage or consequential damage) are expressly excluded.
- Static calculations, lists, and technical drawings of scaffolding parts or structures are prepared without verification and, unless otherwise agreed in writing, are without guarantee.
- Swiss law is applicable.
